About these terms.

These terms and conditions apply to fountainplace.ca, operated by Fountain Place Company Limited (“Fountain Place”, “we”, “us”), 250 Don Park Road, Suite 8, Markham, Ontario L3R 2V1, and to quote requests and services you arrange with us. By using this website or requesting a quote, you agree to them.

If a written quote, proposal, service agreement or contract we sign with you says something different, that document takes priority over these terms for that work.

Using this website.

You may use this website to learn about our services and to contact us. You agree not to misuse it: for example, not to send spam or harmful code, try to gain unauthorized access, or copy large parts of the site by automated means.

We work to keep the website accurate and available, but we may change, suspend or remove content at any time.

Information only.

The information on this website, including service descriptions, guides, FAQs and project examples, is general information. It is not professional advice for your specific fountain, pond or site, and it is not an offer. The right approach for your property depends on an inspection and a written quote.

Project photos and case studies show past work. Results depend on the site, the equipment and the conditions.

Quotes and services.

Sending the quote request form does not create a contract. We will reply to discuss your needs, and a site visit may be needed before we can quote.

Our quotes set out the scope, price and terms for the work. A quote is valid for the period stated on it, and prices for equipment and materials can change after that period. Work is accepted when you approve the quote or sign our agreement in writing.

You agree to give us safe access to the site and accurate information about the fountain, pond or water feature, including known problems, underground services and access restrictions. Unexpected conditions found during the work, such as hidden damage, may change the scope or price. We will discuss any change with you before going ahead.

Weather, seasonal water conditions, equipment lead times and site access can affect schedules. We will keep you informed of any delays.

Warranties.

Workmanship and equipment warranties are those set out in your quote or contract and in the manufacturer’s warranty for any equipment supplied. Warranties do not cover damage caused by misuse, freezing, power problems, lack of maintenance, or changes or repairs made by others.

Payment.

Payment terms are set out on your quote or invoice.

Equipment and parts orders.

Parts and equipment shown on or linked from this website are sold by our sister company, Fountain Depot, at fountaindepot.com, under Fountain Depot’s own terms, shipping and return policies.

Links to other sites.

This website links to other sites, including Fountain Depot, manufacturers and Google. We are not responsible for their content or privacy practices.

Our content.

The text, photos, logos and design of this website belong to Fountain Place or are used with permission. You may share links to our pages, but you may not copy or reuse our content for commercial purposes without our written permission. Brand names of the equipment we service belong to their owners.

Limits of liability.

This website is provided “as is”. To the extent the law allows, Fountain Place is not liable for any loss or damage arising from the use of this website or reliance on its content. Our liability for services is limited as set out in your quote or contract. Nothing in these terms limits liability that cannot be limited under Ontario law.

Privacy.

How we handle personal information is explained in our privacy policy.

Governing law and changes.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Ontario.

We may update these terms from time to time. The effective date at the top of the page shows when they last changed.
